Icyfire.com.au (the 'Website') is owned and operated by SOUNDEXPRESS (ABN 54 660 666 437) and its Supplier Partners (herein referred to as the contractor). The Website provides access to Wedding Fireworks & Dry Ice Services (the 'Services').

1. CUSTOMERS RESPONSIBILITY
IMPORTANT: Before making a booking the customer shall:
1.1  
Notify their venue about the intention to book indoor cold spark fireworks machines.
1.2  Obtain permission from their venue coordinator to proceed with the booking.
1.3  Pay any necessary fire alarm isolation fees charged by the venue if required. 

2. INSURANCES
Once bookings are confirmed, All necessary permits, licences and public liability insurance documents are provided to the venue directly by the senior pyrotechnician in charge of operating the fireworks on the wedding date. Bookings will also be lodged through workcover, council, police and fire departments directly by the senior pyrotechnician if required. Sound Express and Icyfire.com.au do not engage in this part of the booking process.

3. SERVICE DELIVERY
The described services will be provided on the customers wedding date at the wedding reception location at the required times. The services will be provided by a licenced senior pyrotechnician whilst maintaining the utmost level of care and safety precautions.

4. PAYMENT
Payment can be made using any of the available payment methods at the time of booking. Full payment is required to secure the booking. Once the full payment has been cleared, this agreement becomes binding. 

5. REFUNDS
Once an order is placed on the website and the payment is processed there is a binding no refund policy. However, due to an unforeseen circumstance the wedding will need to be postponed, we do allow unlimited postponements and will work together with you to secure a new date. 

6. POSTPONEMENTS
All bookings made via the website are covered by Sound Express Postpone Protection and can be moved to a new booking date an unlimited amount of times as required.

7. COVID POSTPONEMENTS 
In the event that the customer needs to postpone the booking due to the COVID-19 pandemic, the customer will be covered by our Postpone Protection and be able to move the booking date an unlimited amount of times as required moving forward.

8. SELF ISOLATION & QUARANTINE
In the event that the contractor is unable to appear on the day of the wedding due to testing positive to COVID-19 and/or being under a stay at home order due to being a close or casual contact to someone who has tested positive to COVID-19, the contractor will make every effort to find a substitute replacement. In the event that a replacement cannot be found and the customer's event is affected, the contractor will return in full any payments made by the customer and the customer agrees to indemnify the contractor for any loss, damage or liability and no further damages may be sought against the contractor.

9. UNLIKELY EVENTS
9.1  In the unlikely event that the contractor must cancel the delivery of the goods and/or services, the contractor will make every effort to find a substitute replacement. In the event that a replacement cannot be found, the contractor will return in full any payments made by the customer and the customer agrees to indemnify the contractor for any loss, damage or liability and no further damages may be sought against the contractor. 
9.2  In the unlikely event that the contractor is unable to appear on the day of the event, the contractor will make every effort to find a substitute replacement. In the event that a replacement cannot be found and the customer's event is affected, the contractor will return in full any payments made by the customer and the customer agrees to indemnify the contractor for any loss, damage or liability and no further damages may be sought against the contractor. 
9.3  In the unlikely event that the contractor is delayed and the event does not start on time, or significant time is lost during the event due to malfunction of equipment provided by the contractor, the contractor will refund the portion of fees paid prorated to the time lost for that particular service. The customer agrees that the prorated refund will be the full extent of damages the customer is entitled to and no further damages may be sought against the contractor.  

10. DANCE FLOOR & CEILING SPACE
If the amount of dance floor space or ceiling space available for the fireworks is limited or deemed to be unsafe in regard to the amount of clearance between humans and machines, the senior pyrotechnician at his or her discretion reserves the right to cease the operation of some or all of the machines to ensure the safety of all people within the vicinity. The customer agrees that not all machines described in the package may go off at the specified times due to safety reasons and that no refunds or partial refunds will be given.

11. POWER OUTAGES
The contractor is not liable for any power outages that may cause disruption to any services provided by the contractor.

  CONCLUSION OF THIS AGREEMENT  

 
The content of this agreement is subject to change as a result of experience, new information, changes in process requirements and the availability of resources. 


Upon receipt of payment by the contractor, equipment and technicians will be allocated and all of the terms and conditions in this agreement become binding.

This constitutes the entire agreement between the customer and the contractor. No other terms or conditions implied or expressed not included in this agreement apply.
